ARMDALE YACHT CLUB LEARN TO SAIL PROGRAM TERMS OF SERVICE AND PARTICIPATION AGREEMENT This is a binding legal agreement. Clarify any questions or concerns before clicking “I agree”. Prior to participating, participants in Armdale Yacht Club’s (AYC) Learn to Sail Programming (including parents on behalf of children registered in Junior Sailing programs) must acknowledge and agree to the terms outlined in this agreement. 1. DISCLAIMER Armdale Yacht Club and its affiliated Learn to Sail school, and their respective Directors, Officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities in which Learn to Sail activities take place, and representatives (collectively “AYC”) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, Learn to Sail activities, caused in any manner whatsoever including, but not limited to, the negligence of AYC. 2. REGISTRATION & CANCELLATION A confirmation email will be sent to all applicants upon receipt of registration. Once this confirmation email has been sent, participant interest in attending the course is assumed unless Armdale Yacht Club (AYC) is informed otherwise. If, upon receipt of registration, a course is full the applicant will automatically be waitlisted. A waitlist email notice will be sent out to applicants who have been placed on a waitlist. If space comes available, waitlisted registrants will be automatically notified of the availability. Once confirmed, all registrations are subject to a 25% cancellation charge. Cancellations received within two weeks prior to the start date of the course or scheduled session are subject to a 50% cancellation charge. Cancellations made less than two weeks prior to the course start date or scheduled session are non-refundable. 3. WEATHER CONSTRAINTS I acknowledge and agree that sailing by its very nature is subject to weather constraints on any given day. AYC will endeavour to provide Learn to Sail activities in a wide range of weather conditions but may not be able to do so in certain wind and weather conditions for the purposes of health and safety. I further acknowledge and agree that, should AYC deem that Learn to Sail activities are unsafe on a given day, refunds will not be provided for any applicable fees paid for activities on the disrupted day, but best efforts will be undertaken to arrange a catch-up session on another day at no additional charge. 4. RELEASE I, (parent/guardian name), having registered my child as according to the confirmation letter received from AYC do hereby release and forever discharge from personal injury, loss of life, or liability, and do further agree not to make claims, demands or cause any action or claims to be made against AYC, their agents or servants, for any such injury incurred during the above described AYC Learn to Sail Program. PERSONAL HEALTH CIRCUMSTANCES I acknowledge and agree that participants in Learn to Sail activities at AYC are expected to be involved in adventurous and strenuous activity. I acknowledge and agree that these activities are within my abilities and those of my child. I further acknowledge that I will make AYC aware of any medical conditions or personal health circumstances that may limit my ability to fully and safely participate in Learn to Sail activities. I further agree and consent to be administered First Aid by a suitably qualified member of AYC where considered necessary, or by a qualified medical practitioner, including the commission of emergency treatment. 6. ACKNOWLEDGEMENT OF RISKS I understand and acknowledge that: (a) Learn to Sail activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life; (b) AYC may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming; (c) AYC has a difficult task to ensure safety and it is not infallible. AYC will make its best efforts to ensure safety, but nevertheless may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used may malfunction; (d) (COVID-19) The COVID-19 disease has been declared a worldwide pandemic by the World Health Organization and is extremely contagious. AYC has put in place preventative measures to reduce the spread of COVID-19; however, AYC cannot guarantee that I will not become infected with COVID-19. Further, participating in the Learn to Sail activities could increase my risk of contracting COVID-19. 7. DAMAGE TO AYC’S EQUIPMENT AND FACILITIES (a) This policy applies to AYC owned boats, and to privately owned boats used in the program which are under the custody and care of AYC. For the purpose of this policy, these boats are classed as course boats. (b) Boats which are brought by a student for his or her personal use are entirely the responsibility of the owner. AYC assumes no responsibility for loss or damage to private boats or parts thereof from any cause whatsoever. Boats left or stored at AYC are at the owner’s risk. For the purpose of this policy, these boats are classed as private boats. (c) In the event a course boat is damaged minor repairs will be performed by AYC instructors, major damage to course boats will be repaired by a contracted professional. The AYC Coordinator of Sail Training will decide whether the damage is minor or major. (d) The cost of repairs and/or replacement of parts to course boats will be covered by skippers and crews of all the boats involved in collisions or contributing to the loss or damage in accordance with the following cost sharing scheme: a) Repairs on boats that have damage from normal wear and tear will be done at no charge to the individuals responsible for the boats. However, Instructors must be notified at once of the repairs to be done on boats and negligent treatment of boats and/or equipment will not be tolerated. b) Minor damage that is repaired by instructors will be done at no charge to the skippers or crews involved or responsible, provided the damage is reported to instructors at once. c) For major repairs and/or replacement of parts (tillers, rudders, centreboards, etc) which are required because of collision or upset, the costs will be shared as follows: i) Skippers of boats deemed responsible for incident 50% ii) Crews of all boats involved 50% or Skipper of boat deemed responsible for 100% (e) Sails must be cared for as well and should be folded and put away at the end of each day. Battens lost as a result of negligence will be replaced by the crew responsible for the boat. Tears and other damage to sails must be reported immediately to the instructor. 8. RESPONSIBILITY FOR REPAIRS I, (sailor’s name), having enrolled in the AYC Learn to Sail Program accept responsibility for sharing the cost of repairs and/or replacement of parts to course boats in accordance with this boat damage policy as described above. 9. APPEARANCE RELEASE I understand my and/or my child’s photograph or likeness may be copied and distributed by means of various media, including video presentations, television, news bulletins, mailouts, billboards or signs, brochures, placement on AYC’s websites, newsletters, or newspapers. I understand that, although AYC will endeavor to use my and/or my child’s photograph or likeness in accordance with standards of good judgment, AYC cannot warranty or guarantee that any further dissemination of my photograph or likeness will be subject to AYC supervision or control. Accordingly, I release AYC from any and all liability related to dissemination of my child’s photograph or likeness. 10. JURISDICTION I agree that in the event that I file a lawsuit against AYC in relation to my participation in AYC’s Learn to Sail activities, I will do so solely in the Province of Nova Scotia and further agree that the substantive law of the Province of Nova Scotia will apply without regard to conflict of law rules. 11. ACKNOWLEDGEMENT I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon myself, my heirs, spouse, children, guardians, next of kin, executors, administrators and legal or personal representatives under the laws of the province of Nova Scotia. I further acknowledge by signing this agreement I have waived my right to maintain a lawsuit against AYC on the basis of any claims from which I have released herein.
